An Arizona manslaughter sentence is going back for a do-over after an appeals court said an AI-made video of the victim spoke with “undue emotional weight.” The conviction stays. The prison term doesn’t, at least not yet.

In that clip, the AI version of Pelkey forgave his killer and said the two “could have been friends” in another life. The judge said, “I loved that video,” and then gave Horcasitas the maximum sentence of 10 and a half years. The appellate court later said the video had crossed a line and affected how the sentence was imposed.

Wales told 404 Media that swaying the judge was the point. She argued that human connection is powerful, and that a victim’s family should get every chance to express what happened to them. But there’s a difference between impact and puppetry, and this case lands right on that ugly seam.
