AI Regulatory Sandbox Approaches: EU Member State Overview

The EU AI Act requires each Member State to establish at least one AI regulatory sandbox by 2 August 2026, which are controlled environments where AI systems can be tested with regulatory guidance before market release. The EU is providing over €220 million in combined funding across four sector-specific Testing and Experimentation Facilities and supporting implementation through the EU Regulatory Sandboxes for AI (EUSAiR) project and over 150 European Digital Innovation Hubs. Member States are adopting varied institutional approaches—some creating dedicated AI agencies, others using existing regulators—with participation benefits including immunity from administrative fines for good-faith compliance and access to free testing for SMEs and startups.
